Using Say Yay.

Who you are agreeing with
Marketsights, trading as Say Yay. Registered address to be published before the first charge is taken.
Who may use it
An adult opens the account, and a child uses the app under that account with the adult’s supervision and consent. If you are setting this up for a child who is not yours, you need the authority of somebody who can consent for them.
What it is not
Say Yay is a practice companion. It does not diagnose, nothing it computes is a clinical measurement, and it is not a substitute for assessment or treatment by a qualified speech-language pathologist. Nothing in the app or on this site is medical advice, and nothing it shows you should be used to decide whether to seek an assessment. If you are worried about your child’s speech, see somebody licensed to look at it.
What is finished
Say Yay is being built and sold before it is complete. Every game can be played today and the app is not yet in an app store. We publish the gap at /what-we-have-not-built and keep it current. We do not promise a date for anything that does not have one, and where we do give a date we will tell you if it moves.
Your account
Keep your login to yourself. Tell us if you think somebody else has it. We may close an account that is being used to harm somebody, to break the law, or to scrape or resell the content — and if we close yours for any other reason we will refund what you have paid.
The content
The games, characters, artwork and words are ours. The plan we build for your child is yours: print it, keep it, hand it to your therapist, put it on a fridge. You may not resell the app or pass off its content as your own.
Things going wrong
The service is provided as it is. We do not promise it will be uninterrupted or error-free, and we are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud.
Where we are liable, our total liability is limited to what you have paid us in the twelve months before the claim. If that feels small, so does the subscription, and the refund policy is the honest remedy: ask and we refund it.
Changes
If we change these terms in a way that matters to you, we will email you at least 30 days before it takes effect, with a working cancel link in the same email. A change you find out about afterwards is not a thing we are going to do.
Law
The governing law and venue will be published before the first charge is taken, and will not be changed retroactively. Nothing here takes away a consumer right you have where you live.
